Is there any way to force 40 MHz channel width on 2.4 GHz WiFi on OPO?

The WiFi connection is capped at 72 Mbps (connection speed, not actual speed). I heard that it is a hardware issue, but is like really non-changeable, or can be implemented in a custom ROM/Kernel ?
